Terms of Service

1. Agreement to Terms

By downloading, installing, or using Atlas Budgeting (“App,” “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and PKM Software, the Texas-based operator of Atlas Budgeting (“we,” “our,” or “us”).

2. Description of Service

Atlas Budgeting is a personal finance application that helps you:

• Track spending and manage budgets with a 50/30/20 framework.
• Detect and organize recurring subscriptions and free trials through supported bank connections or manual entries. Gmail connection and email scanning are not currently offered.
• Receive notifications about upcoming charges, trial expirations, and price changes.
• Analyze subscription spending and identify potential savings (“zombie subscriptions”).
• Access premium reports and planning features through an applicable subscription or access grant.

Atlas Budgeting is a financial management tool, not a financial advisor. The insights and recommendations provided by the App are for informational purposes only and should not be construed as financial, investment, tax, or legal advice.

3. Eligibility

You must be at least 13 years old to use Atlas Budgeting. By using the App, you represent and warrant that you are at least 13 years of age. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. Account Registration

• You must create an account to use the mobile app. Public website guides and the subscription cost calculator do not require an account.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to provide accurate, current, and complete information and to keep it updated.
• You must notify us immediately of any unauthorized use of your account.

5. Acceptable Use

You agree NOT to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to any portion of the App or its related systems.
• Reverse engineer, decompile, or disassemble the App except where applicable law or a third-party software license permits it.
• Interfere with or disrupt the integrity or performance of the App.
• Use the App to transmit spam, malware, or harmful content.
• Sell, resell, or commercially exploit the App without our written permission.
• Create multiple accounts to circumvent limitations or bans.
• Misrepresent your identity or affiliation with any person or organization.

6. Third-Party Integrations

6.1 Gmail (Google)

Gmail connections and email scanning are not currently offered. If these features return, the app will explain the access requested and ask for permission before enabling them. If you previously authorized Gmail access, you can revoke it at Google account permissions.

6.2 Plaid (Bank Connection)

Atlas Budgeting uses Plaid to provide bank account linking. By connecting your bank account, you agree to Plaid’s End User Privacy Policy. Atlas Budgeting receives read-only account and transaction information; we cannot initiate transfers or access your full account credentials.

6.3 Anthropic (Claude AI)

AI email processing is not currently offered. Any future optional feature that shares information with an AI provider will need appropriate disclosure and permission before it is enabled. Ordinary budgeting calculations and the website calculator do not require an AI provider.

6.4 App Store

In-app purchases are processed by Apple (App Store). Apple’s Terms of Service and refund policies apply. Atlas Budgeting has no control over purchase processing or refunds handled by Apple.

7. Subscription & Billing (Premium Features)

Atlas Budgeting offers free and premium tiers. Free accounts have access to basic subscription tracking and budgeting features. Premium features, such as advanced reports and unlimited subscription tracking, require an active subscription or an applicable access grant. The app displays current plan features before purchase.

• Premium subscriptions renew automatically and are billed through your App Store account at the price and billing frequency shown before purchase, unless canceled through Apple. Apple handles any required price-change notices and consent.
• An Atlas access trial granted without an App Store purchase does not charge you automatically. If you accept an auto-renewing introductory offer through Apple, its checkout terms explain when billing begins and how to cancel.
• You may cancel at any time through your App Store account settings. Cancellation takes effect at the end of the current billing period.
• We do not issue refunds for unused portions of a subscription period, except as required by applicable law or App Store refund policies.
• We may change subscription prices with reasonable notice. If you do not agree to a price change, you must cancel before it takes effect.

8. Intellectual Property

PKM Software and its licensors retain their respective rights in the app and website. Third-party software, fonts, names and marks remain the property of their respective owners and are subject to their applicable licenses. We do not claim ownership of third-party components or merchant branding. References to a merchant identify the relevant service and do not imply that the merchant sponsors or endorses Atlas.

You are granted a limited, non-exclusive, non-transferable license to use Atlas for your personal purposes, subject to these Terms. This does not restrict rights granted directly by an applicable open-source license. See our third-party notices and data sources.

9. Financial Information Disclaimer

Atlas Budgeting provides budgeting tools, subscription tracking, and spending analysis for informational purposes only. The App is not a financial advisor and does not provide financial, investment, tax, or legal advice. Any recommendations (e.g., “cancel unused subscriptions,” “switch to annual billing”) are suggestions based on your data and should not be relied upon as professional financial guidance.

Verify subscription details and deadlines with your providers. Atlas offers guidance; recording a cancellation does not cancel a provider subscription. Annualized costs, savings projections and currency conversions are estimates, not guaranteed outcomes or settlement amounts. None of these Terms limits rights or remedies that applicable law does not allow us to exclude.

10. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY ERRORS WILL BE CORRECTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ATLAS BUDGETING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE APP.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $10 USD, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold harmless Atlas Budgeting and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the App or violation of these Terms.

13. Termination

We may terminate or suspend your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App immediately ceases. You may delete your account at any time through the App’s Settings. Provisions that by their nature should survive termination will survive, including intellectual property rights, disclaimers, and limitations of liability.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law provisions. Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the American Arbitration Association’s Consumer Arbitration Rules, rather than in court, except that either party may seek injunctive relief for intellectual property infringement.

CLASS ACTION WAIVER: You agree that any arbitration or legal proceeding shall be conducted only on an individual basis and not as a class, consolidated, or representative action.

15. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by updating the “Last updated” date and, where appropriate, sending a push notification or email. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.
